Pool & Spa Safety Inspection Process

Victorian pool & spa owners are required to have their safety barriers inspected and to lodge a certificate of barrier compliance with their council. If a safety barrier is not compliant, it is the owner’s responsibility to make the barrier compliant. We are an accredited SPASA certified Melbourne Pool Inspector and can assist you with ensuring that your safety barriers are compliant with local council requirements.

Victoria introduced tougher pool safety requirement on the 1st of December 2019, that requires any landowner that has a pool or spa on their property to register their compliant pool or spa with their local council. It is now mandatory for owners of land where a swimming pool or spa is located to register their pool or spa with the relevant council. The new pool safety laws apply to swimming pools and spas that are capable of holding more than 300 mm (30 cm) of water. This includes permanent pools, above ground pools, indoor pools, hot tubs, bathing or wading pools and some relocatable pools.

Why Do I Need a Pool Fence Inspection?

On average, four young children die in Victoria in home swimming pools or spas each year, and many more are taken to hospital for near-drownings.

The social and economical impacts that are caused by these tragedies extend well beyond those whose lives are immediately impacted. (More information is available upon request).

These regulations are aimed at protecting young lives.

For your own financial security you should understand that compliance with legislation is an important aspect to any home public- liability insurance.

In Melbourne, as in many other places around the world, pool fence inspections are required to ensure the safety of children and others around swimming pools. The Victorian Building Authority (VBA) mandates that all private swimming pools and spas must have compliant safety barriers, including pool fences, gates and latches. The primary reasons for requiring pool fence inspections in Melbourne, or any location, typically include:

  1. Child Safety: The most critical reason is to prevent accidental drowning, especially among young children. Pool fences act as a barrier that can deter unsupervised access to the pool area, reducing the risk of accidents.

  2. Legal Requirements: Local and national governments often have laws and regulations in place that mandate the installation and maintenance of pool fences. These laws are designed to enforce safety standards and reduce the likelihood of pool-related accidents.

  3. Liability Reduction: Property owners can be held liable for accidents that occur on their premises, including pool-related incidents. Complying with pool fence regulations and undergoing regular inspections can help reduce the property owner's liability in case of an accident.

  4. Community Safety: Ensuring that swimming pools are properly fenced also benefits the broader community by reducing the risk of accidents that could impact neighbors and passersby.

  5. Insurance Requirements: Some insurance providers may require property owners to have a compliant pool fence and undergo regular inspections as a condition of coverage. Failing to meet these requirements may lead to policy cancellations or increased premiums.

  6. Property Sale and Rental: When selling or renting out a property with a swimming pool in Melbourne, it's often necessary to have a compliance certificate showing that the pool fence meets safety standards. This certificate can be obtained through a pool fence inspection.

  7. Public Health: Properly maintained swimming pools and fences help maintain public health standards, as they can prevent contaminants and debris from entering the pool.

It's important to note that specific regulations and requirements for pool fence inspections can vary by location and can change over time. Property owners in Melbourne should check with their local government or relevant authorities to understand the current rules and regulations regarding pool fences and inspections in their area. Failure to comply with these regulations can result in fines, legal consequences, and, most importantly, the increased risk of tragic accidents.
